Understanding New York State Overtime Laws

New York State Labor Law Requirements

New York State Labor Laws require that most employees receive overtime compensation for every hour worked above the regular workweek threshold.

  • Standard Employees: Overtime after 40 hours per week
  • Residential Employees: Overtime after 44 hours per week
  • Overtime Rate: 1.5 times regular hourly pay (time and a half)
  • Cannot Be Waived: Employees cannot give up their right to overtime

How Overtime is Calculated

Step 1: Determine Eligibility

Check if your job is exempt from overtime requirements (see exempt jobs below)

Step 2: Count Overtime Hours

Subtract 40 hours (or 44 for residential) from weekly hours to get overtime hours

Step 3: Calculate Overtime Rate

Multiply regular hourly pay by 1.5 to get overtime pay per hour

Step 4: Calculate Total Pay

Multiply overtime hours by overtime rate and add to regular pay

Jobs Exempt from NY Overtime Requirements

Exempt Under Both NY & Federal Law:

  • • Executive, Administrative, or Professional employees
  • • Outside salespeople
  • • Municipal, State, or Federal government workers
  • • Farm laborers
  • • Certain volunteers, interns, and apprentices
  • • Taxicab drivers
  • • Members of religious orders
  • • Certain religious/charitable institution workers
  • • Part-time babysitters
  • • Camp counselors
  • • Fraternity/sorority association workers

⚠️ Important Note:

Some jobs exempt from overtime under Federal FLSA are still eligible for overtime under NY State Labor Law.

However, for these jobs, overtime pay must equal 1.5 times the state minimum wage, regardless of the employee's usual pay rate.

💼 Example: How Much is Overtime Worth?

Question: What is the overtime pay if I make $14.20 per hour in New York?

Calculation: $14.20 × 1.5 = $21.30

Answer: You are entitled to $21.30 for every hour you work overtime!

Annual Impact: If you work 20 overtime hours per month, that's an extra $5,112 per year in overtime pay.

⚠️ Know Your Rights

  • Cannot Waive Rights: Workers cannot give up their claim to overtime pay. Any agreement to waive overtime is unlawful.
  • Must Be Paid: Employers must pay overtime even if they announced that overtime work would not be allowed or would not be paid unless authorized in advance.
  • Better Terms Apply: If your employment agreement includes greater overtime compensation than State and Federal laws, you are entitled to that higher amount.
